This includes all the software (e.g. all electronic files and printed papers). ----------------------------------------------------------------------------- -- License Agreement -- 1) General: You are granted non-exclusive rights to use the PRODUCT as set forth in this license provided you agree to and comply with all conditions in the license. The laws of your country will apply to your usage, copying, and distribution rights of the PRODUCT. However, all places where this license conflicts with these, this license is to take higher precedence to the degree permitted by applicable law. The laws of the country Denmark shall govern this agreement. Any litigation or other dispute resolution between the parties relating to this agreement or its construction shall take place in a court of competent jurisdiction in the country Denmark. You must accept this license before installing and using this PRODUCT. 2) Disclaimer: This PRODUCT is NOT intended for use in or in conjunction with life-critical or mission-critical systems. The PRODUCT is provided "as is" without warranty of any kind, either express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. In no event shall Micro-Sys, copyright holders, developers or any other party involved in the ownership, creation, or delivery of this PRODUCT be liable for any direct, indirect, consequential, or incidental damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this Micro-Sys PRODUCT, even if Micro-Sys has been advised of the possibility of such damages. Under no circumstances whatsoever can Micro-Sys' liability exceed the amount received by Micro-Sys for the license(s). -- PRODUCT [Free Edition] License Agreement Specifics -- a) General: You are granted non-exclusive rights to use the PRODUCT as set forth in this license provided you agree to and comply with all conditions in the license. The PRODUCT may occasionally make accesses to internet to check for updates, report errors and confirm license usage. You may not rent, lease, sell or sublicense the PRODUCT. You are very welcome and in fact even encouraged to distribute the complete and unchanged PRODUCT package - even on medias such as CD-ROM and DVD publishings, BBSes, and download-sites on the Internet. -- PRODUCT [Pro Edition] License Agreement Specifics -- a) General: This PRODUCT is "trialware". This means that you, as a user, get 30 days to test the PRODUCT before deciding if you want to buy a "registered license" for it or not. If you decide not to buy it, or the 30 days testing period has expired, you must discontinue any further use of the PRODUCT. The PRODUCT may occasionally make accesses to internet to check for updates, report errors and confirm license usage. Except as set forth herein, you may not rent, lease, or sublicense the PRODUCT. You may not embed or componentize the PRODUCT and make it available for use by third parties. You are very welcome and in fact even encouraged to distribute the complete and unchanged unregistered PRODUCT package - even on medias such as CD-ROM and DVD publishings, BBSes, and download-sites on the Internet. You may not publish serial/key codes or files that "unlock" the PRODUCT from the "unregistered" state. This includes (but is not limited to) publishing serial/key codes on internet sites. Doing so will revoke the right to use this PRODUCT forever and will also terminate the given (if any) serial/key. You are not allowed to sell any original or modified versions of the PRODUCT without explicit and continued consent by Micro-Sys. b) Legally registered versions: Having "X" number of licenses means that the PRODUCT can be used by "X" "USERS". The "X" refers to any given number of licenses (e.g. in the above paragraph you could replace "X" with 10). Formally, each license must belong to a person, company, or organization. We define that as a "LICENSE-HOLDER" in this document from now on. A "LICENSE-HOLDER" can assign the usage rights of each license to a person within the company or organisation. We define this person as the "USER". If the "LICENSE-HOLDER" is a person the "USER" can be the same person. There can never be multiple "USERS" assigned to the same PRODUCT license. However, the "LICENSE-HOLDER" can transfer the usage rights to another person incase the former "USER" leaves or changes job position. |
